Terms and Conditions

1- Object

These Terms and Conditions govern the contracts concerning the provision of Italian language courses concluded at a distance through telematic tools between users who qualify as consumers pursuant to art. 3 Legislative Decree. 206/ 2005 – Consumer Code (hereinafter referred to as “Users”) and the association Scuola di italiano Mondavio, C.F. 90046420411, Piazza Don Minzoni 2, 61040 Mondavio (PU), Italy, e-mail info@scuolaitalianomondavio.it (hereinafter referred to as “Professional”).

2 – Conclusion of the contract

The contract is understood to be finalized when the User receives the confirmation of registration from the Professional. The confirmation is sent upon payment of the registration fee/down payment.

3- Withdrawal 

The User has the right to withdraw from the contract without having to give any reasons and without penalty within 14 days after the conclusion of the contract by any explicit statement of his decision to withdraw from the contract or by using this form, to be sent to the Professional’s contact details. The Professional will refund the price paid within 14 days of the notice of withdrawal using the same means of payment used for the initial transaction. The User is entitled to request a refund by a different means of payment, but in that case any additional costs arising from the chosen means of payment will be borne by the User.

The User has the right to withdraw from the contract by the fifteenth day prior to the start of the course. The Professional will refund half of the deposit paid within the next 14 days.

The User also has the right to withdraw from the contract beyond the fifteenth day prior to the start of the course, but in that case he/she will not be entitled to any refund.

4 – Inability to attend courses.

If the user is unable to attend the course in which he or she is enrolled and has given notice to the professional promptly and no later than seven days prior to the start of the course, he or she will receive a voucher valid for one year that will allow him or her to choose a new class date.

5 – Lack of a suitable language level group for the user

In the event that there is no language level group suitable for the user, in order to avoid placing the user in a group of too high or too low level, the Professional offers to replace the hours of course attendance with hours of individual lessons at the same course price.

6 – Communications and complaints

For information, clarifications or complaints, the user may contact the Professional using the contact details given in the contact section.

7- Jurisdiction and ODR platform.

For disputes between the seller and the Consumer arising from the online sales contract, the place of jurisdiction is exclusively that of residence or domicile of the Consumer, which is mandatory under Article 66-bis of the Consumer Code.

This is without prejudice to the right to refer to the competent Judicial Authority for disputes arising from the online sales contract.

8- Applicable Law.

This contract is governed by Italian law.

For anything not expressly governed by these Terms and Conditions please refer to the rules of D. lgs. 206/2005 (Consumer Code) and in particular Part III, Title III, Chapter I, the Civil Code and D. lgs. 70/2003 on certain legal aspects of information society services and in particular on electronic commerce.
